Our Work

Commercial Litigation

  • Three commercial brokers left a nationally renowned brokerage firm. Contrary to their employment agreement, they attempted to steal a pending transaction. Upon learning of their malfeasance, and as the commission check was being issued, the attorneys at C. Kyle Pugh, P.C. filed a claim for arbitration and an additional lawsuit, which stopped the attempted theft. The arbitrator found the three brokers guilty of conspiring to commit fraud, actually committing fraud, and breaching their contracts. Our client was awarded $875,219 in damages. The case was settled for $775,000 pending confirmation of the arbitration award. in state and federal court.

  • A national sales director abruptly resigned his position with an international manufacturing firm. When he resurfaced a month later, he had formed a company (with partners) that was directly competing with our client. We quickly conducted a forensic analysis of his computers and documented that he had downloaded all of our client’s trade secrets including client lists and proprietary pricing. We quickly filed suit and obtained a temporary restraining order against the former director. We then notified his new partners that they were complicit in the theft of our trade secrets. The case quickly resolved when the new company terminated the former director, and a final judgment and permanent injunction were entered against him.

  • A Dallas-based company employed our client to provide Information Technology services. Upon completion, the company decided not to pay our client. The attorneys at C. Kyle Pugh, P.C. promptly sued the company and its president in his individual capacity. A judgment was obtained and we collected the judgment in full, including our client’s attorney’s fees and costs.

Personal Injury

  • Our client was backing out of his driveway when a postal truck struck his vehicle at less than 6 miles per hour. Our client had a pre-existing condition that made his vertebrae more susceptible to being fractured. Due to the minor impact, our client became permanently quadriplegic. We sued the United States of America under the Federal Torts Claims Act. After a four-day trial before U.S. District Judge Reed O’Connor in the Fort Worth Division of the U.S. District Court for the Northern District of Texas, a verdict of more than $26.5 million was returned favoring our client and his wife. The verdict was supported by multiple expert witnesses secured by our firm, including two orthopedic surgeons, a biomechanical engineer, a mechanical engineer, an accident reconstructionist, a life care planner, and a local home builder. More information on this case may be viewed here.

  • Our client sustained bi-lateral hip injuries when she was traveling through an intersection and was struck by another driver. The defendant driver was a traveling saleswoman who was distracted and failed to yield the right of way at a stop sign. We sued the driver and the corporation she worked for. The Defendants disputed liability and damages. After a four-day jury trial, a verdict totaling $1,918,657.29 was returned. The evidence we presented included testimony from two board certified hip surgeons, an engineer, a vocational economist, and a registered nurse. The verdict was paid in full by the Defendants.

  • A four-year-old boy suffered a disfiguring injury to his right arm in a motor vehicle accident caused by his mother, who was the faulty driver. His injuries required reconstructive plastic surgery. $1.2 million settlement.

  • A 72-year-old grandmother was struck in an intersection in Arizona by a 16-year-old driver who ran a red light. He had obtained his driver’s license four days earlier. The grandmother died one year later of complications from her injuries and an aggravation of a pre-existing condition. Confidential settlement obtained on the eve of trial.

  • 47-year-old woman suffered severe fractures to her arm and wrist while airing up a tire on a dolly (hand truck). The design of the dolly wheel and tire was defective. Confidential settlement obtained. The manufacturer of the dolly issued a nationwide recall of 292,000 dollies with the United States Consumer Product Safety Commission as a result of our litigation. We continued to successfully represent additional plaintiffs, across the nation, against the dolly manufacturer.

Legal Malpractice

  • A personal injury attorney in North Texas forged our client’s and her husband’s signature on a settlement check, kept the money, did not disclose the settlement to the client and did not pay the medical providers who treated her for personal injuries. The attorney repeatedly told the client to be patient and that he was still working on the case. The client hired the law firm of C. Kyle Pugh, P.C. who quickly investigated the case, confirmed the fraud, filed suit against the attorney and his law firm, filed a grievance with the State Bar of Texas and opened a criminal investigation with state law enforcement. After securing a judgment and having a receiver appointed, a settlement was obtained, the client was fully paid, the attorney resigned his law license while the criminal prosecution against the attorney proceeded.

  • A bankruptcy attorney in San Antonio missed a deadline, which resulted in our client losing his home and all of his equity in the home. Our client hired a second attorney to file suit against the first attorney. The second attorney missed the deadline to file a lawsuit. We promptly prosecuted the second attorney for breaching the statute of limitations while proving up the damages caused by the first attorney. Our work led to a confidential settlement that allowed our client to purchase a new home.

  • A tax attorney in Dallas provided tax shelters to affluent clients across the country. He charged significant fees, both for the initial tax shelter but also to “administer” the shelters. The IRS issued a ruling disallowing the tax shelters designed by the tax attorney, which resulted in his many clients having to pay the withheld taxes with significant penalties and interest. The law firm of C. Kyle Pugh, P.C. filed a lawsuit against the tax attorney and his law firm. After extensive discovery and deposing the attorney, his scheme became clear. A significant recovery was obtained for our client. We subsequently represented five additional clients against the tax attorney, recovering meaningful settlements for all of them. The IRS and FBI subsequently raided the tax attorney’s office and opened a criminal investigation into his fraudulent tax shelters.
